The Ontario Court of Appeal has substantially upheld a $3 million award for chronic pain following on medical malpractice, deducting only some $350,000 from the trial judge’s award in Degennaro v. Oakville Trafalgar Memorial Hospital. “Even with the reduction I believe that the award is still far and away the biggest chronic pain award in Canada,” says Alf Kwinter, who with colleague Bill McMaster of Singer, Kwinter represented the plaintiff at trial.
